1. Service Description

Torial provides an AI-powered educational video generation service designed for students and educators. You can submit homework problems, study topics, or educational content, and our AI will generate corresponding educational videos to help you learn.

Our service includes:

• Text-to-video generation for educational content
• Document upload support (PDF, DOCX, PPTX, TXT)
• Multiple AI model options
• Video customization (voiceover, captions, model selection)
• Monthly subscription with video generation credits

2. Account Registration and Security

To use our service, you must:

• Be at least 13 years old
• Provide accurate account information (name, email)
• Create a secure password or use Google Sign-In
• Keep your login credentials confidential
• Notify us immediately of any unauthorized access to your account

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage from unauthorized account access due to your failure to maintain account security.

3. Communications and Marketing

By creating an account with Torial, you agree to receive communications from us, including:

• Service Communications: Account notifications, password resets, security alerts, and service updates
• Marketing Emails: Product announcements, new features, tips for using Torial, special offers, and promotional content
• Subscription Updates: Billing confirmations, payment receipts, and subscription renewal reminders

You may unsubscribe from marketing emails at any time by clicking the "unsubscribe" link at the bottom of any marketing email or by contacting us at hello@trytorial.com. Please note that you cannot opt out of essential service communications related to your account and transactions.

4. Acceptable Use

Permitted Uses:

• Educational content creation
• Learning and instructional materials
• Academic and research purposes

Prohibited Uses:

• Generating inappropriate, harmful, or illegal content
• Creating content that violates intellectual property rights
• Using the service for spam or malicious purposes
• Sharing your API credentials with unauthorized parties

4. Content and Intellectual Property

4.1 Your Content

• You retain all ownership rights to your input content (prompts, documents, text)
• By submitting content, you grant us a license to process it for video generation
• You represent that you have the right to use and share any content you submit
• You are responsible for ensuring your content does not violate any laws or third-party rights

4.2 Generated Videos

IMPORTANT: All videos you generate are publicly accessible. By using our service, you acknowledge and agree that all videos you generate will be publicly accessible to anyone with the URL. Videos will appear on our public Explore page and will be submitted to search engines (including Google) for indexing. Do not include any private, confidential, or sensitive information in your prompts.

• You own the generated videos created from your prompts
• You may use generated videos for personal, educational, or commercial purposes
• Public Visibility: All generated videos are publicly accessible via unique URLs and displayed on our public Explore Videos page
• Search Engine Indexing: We automatically submit all video pages to Google and other search engines for indexing. Your videos may appear in search results.
• Unlisting Videos: While videos are public by default, you may request to have your videos unlisted from the Explore page and search engine indexing by contacting us at hello@trytorial.com. Unlisted videos will still be accessible via their direct URL but will not appear in public listings or search results (subject to search engine cache delays).
• We retain a non-exclusive license to use generated content for service improvement and quality assurance
• We may use anonymized, aggregated data from video generation for research and development
• Your Responsibility: You are solely responsible for ensuring that your prompts and generated content do not contain personal information, confidential data, or content that violates any laws or third-party rights

Note: Once indexed by search engines, videos may remain in search results and cached pages even after deletion from our service. We cannot control or remove content from third-party search engine caches.

Playground Video Expiration: Playground videos are automatically deleted after 7 days and cannot be recovered. Download any videos you want to keep before they expire. We are not responsible for expired videos.

4.3 Torial's Intellectual Property

The Torial platform, including our website, software, AI models, logos, and branding, are owned by Torial and protected by copyright and trademark laws. You may not copy, modify, or distribute our platform or technology without our written permission.

5. Service Availability and Limitations

• We provide the service "as is" without guarantees of uptime
• Processing times may vary based on complexity and system load
• We reserve the right to implement rate limits and usage restrictions
• Service may be temporarily unavailable for maintenance

6. Subscription and Billing

6.1 Subscription Plans

We offer monthly and annual subscription plans that include:

• Monthly Plan: $9.99/month - includes 20 video generations per month.
• Annual Plan: $83.88/year (equivalent to $6.99/month) - includes 20 video generations per month. Save 30% compared to monthly billing.
• Free Tier: New users receive 2 free videos upon account creation. No additional free videos are provided.
• Additional Videos: If you require more than 20 videos per month, please contact us at hello@trytorial.com to discuss custom arrangements.
• Credit Reset: Your video credits reset to 20 on the first day of each billing cycle (monthly for monthly plans, annually for annual plans)
• No Rollover: Unused credits do NOT carry over to the next month
• Active Subscription Required: Credits are only available while your subscription is active

6.2 Billing and Payments

• Subscriptions are billed monthly on the date you subscribe
• Payments are processed securely through Stripe
• You authorize us to charge your payment method each billing cycle
• If payment fails, your subscription may be suspended until payment is resolved
• Pricing is subject to change with 30 days' notice

Important: Video credits expire at the end of each monthly billing period. Use your credits before they reset.

6.3 Cancellation and Refunds

• You can cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of your current billing period
• You retain access to your credits until the end of the paid period
• No refunds are provided for partial months or unused credits
• Failed video generations will be refunded as credits to your account
• We may provide refunds at our discretion for extenuating circumstances

7. Data and Privacy

• We collect and process data as described in our Privacy Policy
• Your content may be processed using third-party AI services
• We implement security measures to protect your information
• We may moderate content for safety and compliance

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our liability is limited to the amount you paid for the specific service
• We are not liable for indirect, consequential, or special damages
• We do not guarantee the accuracy or quality of generated content
• You use the service at your own risk

9. Account Termination and Suspension

9.1 Your Right to Terminate

You may cancel your subscription at any time. Upon cancellation:

• Your subscription continues until the end of your current billing period
• You retain access to credits and generated videos during this time
• No refunds are provided for the remaining subscription period
• Your account data is retained for 30 days, then permanently deleted

9.2 Our Right to Terminate

We may suspend or terminate your account immediately if you:

• Violate these Terms and Conditions
• Generate prohibited or illegal content
• Engage in fraudulent or abusive behavior
• Fail to pay subscription fees
• Pose a security or legal risk to our service or other users

10. Changes to Terms

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the updated terms.

11. Dispute Resolution and Governing Law

These Terms and Conditions are governed by the laws of the United States, without regard to conflict of law principles.

Informal Resolution: Before filing any legal claim, you agree to contact us at hello@trytorial.com to attempt to resolve the dispute informally.

Arbitration: Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court. You waive your right to a jury trial.
